It is agreed that the terms set out in this contract are the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

1.0 Payments

1.1 Booking fee: A non-refundable booking fee of 20% of the total fee is charged when the client signs this contract, the fee is deducted (in full) from the total contract price.

1.2 Final Balance:

The balance of the contract price should clear NPhotography on or before 30 days prior to the wedding day.

2.0 Requests/Coverage:

The client understands and accepts that the photographic coverage will be as NPhotography professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes.   Any special requests not notified on this contract must be made by the client to NPhotography in writing.

3.0 The Photographer:

On occasions and without notice it may be necessary for NPhotography to be substituted by another competent photographer, (e.g. due to serious ill health)

4.0 Images :

All image sizes are nominal. NPhotography will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record electronically the exact colour as seen by the human eye.

5.0 Copyright:

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the copyright, designs and patents act 1988. With all packages the licence/permission to print and reproduce the images is provided within this contract.

6.0  Licence:

NPhotography shall be granted complete artistic licence including in relation to the poses photographed and the locations used.  NPhotography’s judgment regarding the locations/poses and number of images made shall be final. Due to the vagaries of weather and the willingness of subjects it may not be possible to capture all of the images requested.

7.0  Force Majeure or Act of God:

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

8.0 Display:

The client hereby allows NPhotography to display any images included in this contract in it’s portfolio, literature, web site, social media and advertising.

9.0  Cancellation:

The client may cancel this contract at any time by giving written notice to N Photography but in doing so shall forfeit any monies paid. Should cancellation be received by NPhotography less than 12 weeks prior to the date of the ceremony, the client shall in addition pay a sum equal to 50% of the contract value. The said sum shall be payable as compensation as an estimate of the loss NPhotography would suffer.

9.1 COVID-19/Pandemic:

If the client cancels (any length of time before the wedding date) due to lockdown or government restrictions, the client is entitled to amend the date. 3 alternative dates must be offered to NPhotography. If a new date cannot be agreed upon, the client can use any deposit monies paid, towards an alternative photography service with NPhotography.

10.0 Limitation of Liability: In the unlikely event of total photographic/electronic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

11.0 Professional Exclusivity: It is agreed that NPhotography shall be the only professional stills photographers engaged to record the wedding photographically unless discussed prior to the wedding day and agreed by both parties.

12.0 Lead Time: Images will be provided on USB within 6 weeks after the date of your event/wedding. We do ask for your storybook order to be placed within 3 months of receiving your photographs; however, your photographs are available for a 12 month period. Turn around for book design is 6 weeks and printing/binding an additional 6 weeks after approval. For all prepaid orders if we do not receive your order within 12 months we have the right to refuse continuation of our services.  Any further production may incur additional costs.

13.0 Requests:If the coverage exceeds 6 hours, we do request that a suppliers meal be provided for your photographer/s or alternatively please inform us that you are happy for us to leave your wedding to get something over this time. A short break will be taken to eat at a suitable time over the 8-9 hour day. (normally when you attend your wedding breakfast)
